I have worked in the Canadian real estate industry since 1980 with such shopping centre/office developers as Marathon Realty Company Limited, Fidinam Canada Limited, and J.D.S. Investments Limited. During this period I spent three years as legal counsel with Canada¹s then premier retailer Dylex Limited. Consequently I have drafted and negotiated documentation from both sides of the landlord/tenant relationship and have obtained a practical knowledge of remedies, property management concerns, environmental issues, franchising, risk management and leasing issues for retail/office tenancies and land leases. In 1994, I started my own law practice with an emphasis on commercial leasing.

1989 ­ 1993: Senior Legal Counsel at J.D.S. Investments Ltd. The company had over 4 million square feet of primarily retail, with some office and a sprinkling of industrial. The retail consisted of several first class enclosed malls, some ³B² enclosed malls and retail strips. The company was valued at over $350 million dollars. Primary responsibility was on the legal and practical issues that arose with our tenants. I worked comfortably with other senior management and instructed outside counsel where required.

1986 ­ 1988: As one of three in-house counsel with Dylex Limited, we were responsible for all legal aspects of the real estate portfolio. Dylex Limited had over 900 primarily fashion-oriented stores throughout North America.

Special Projects

Drafted the master form of retail Lease for Dundee¹s Northgate Shopping Centre, Regina, Saskatchewan.

Drafted the master form of retail Lease for various strip mall landlords.

While senior legal counsel at J.D.S., I quarterbacked and successfully implemented a plan to recover over $400,000.00 from a recalcitrant tenant. This tenant was trying to goad the landlord into terminating its lease and then upon termination would probably have disputed the damages in court. Through my action, I was able to recover this money without requiring outside counsel or commencing a costly and protracted legal action.

While employed at Itco Properties, I undertook a review of a company¹s insurance coverage which resulted in a substantial decrease in premiums, while expanding coverage and retaining the quality of insurer.
